A Motion to Dismiss asks the court to dismiss the Complaint or certain claims contained in the Complaint. The defendant may file a Motion to Dismiss instead of an Answer or may file the Motion in conjunction with an Answer. If the court grants the Motion, the claims are dismissed.
An Answer is filed by a Defendant in response to a Complaint. In an Answer, the Defendant responds to all of the claims alleged by the Plaintiff in the Complaint, and the Defendant may assert defenses and counterclaims against the Plaintiff.
